Attorney, Paul J. Sheston, of The Checkett Law Firm, PLLC, recently obtained a Summary Judgment in Maricopa County Superior Court (Grosnoff v. St. Luke’s Medical Center, et al., CV2013-009728) on behalf of an Arizona hospital and a registered nurse in a case alleging negligent catheter insertion resulting in permanent urological injuries.

After nearly three years of litigation, the case was dismissed for a lack of required expert medical causation testimony. During his deposition, Plaintiff’s disclosed urological expert recanted his previously disclosed expert opinions and testified that Plaintiff required a transurethral resection of the prostate (TURP) surgery as a result of pre-existing benign prostatic hyperplasia (BPH), and not from the subject catheter insertion.

The same expert confirmed the absence of any objective medical evidence to suggest any alleged urethral injury or trauma as a result of the subject Foley catheter insertion following orthopedic surgery.
